At this time, he can also answer any questions you have about these amendments to the covenants.In particular, some questions have come up about enforcement. Here is Aaron’s response…
A number of homeowners have expressed concern about the architectural review committee’s enforcement of the covenants. Residents should read closely the provisions of Articles VII and X. Those provisions place the ultimate enforcement authority with the Board, which is subject to rules and regulations that need to be approved by a majority of homeowners. The amendments (Section 10.03) also give homeowners an express right to file grievances with the Board to challenge any adverse action. These provisions were collectively designed to ensure that (1) the process for enforcing the covenants is clearer than our current HOA documents; (2) there are more concrete, written standards governing both the architectural review committee and the board with respect to covenant enforcement; and (3) residents have a fair opportunity to challenge any decision that they disagree with.
Finally, keep in mind the following in regard to the amended covenants…
- A majority of the 171 lots in LDC need to vote in favor for them to pass
- If the amendments do not pass, then it will require a 95% homeowner vote to amend them before May 5, 2033.
